2. Description of Services

XE provides a decentralised Layer 1 protocol and related infrastructure services including but not limited to machine-to-machine communication, identity and reputation systems, resource discovery, token transactions, compute and storage leasing, and the Machina community platform. The specific features and functionality available to you depend on your participation level and subscription plan.

3. Account Registration

To use certain features of the Services, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password and wallet keys secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorised access

4. Acceptable Use

You agree not to use the Services to:

• Violate any applicable laws or regulations
• Infringe intellectual property rights of others
• Transmit malware, viruses, or harmful code
• Engage in spam, phishing, or fraudulent activities
• Interfere with or disrupt the Services or network nodes
• Attempt to gain unauthorised access to any systems
• Host or distribute illegal content
• Resell or redistribute the Services without authorisation

5. Payment Terms

Certain Services require payment. By subscribing to paid Services, you agree to pay all applicable fees. Fees are non-refundable except as expressly stated in these Terms or required by law.

6. Service Level Agreement

Our Service Level Agreement (SLA) provides uptime guarantees and service credits for qualifying downtime. The SLA is incorporated into these Terms by reference. Current SLA commitments vary by plan and are detailed in your subscription agreement.

7. Intellectual Property

The Services and all associated content, features, and functionality are owned by XE and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you upload to the Services.

8. Data and Privacy

Our Privacy Policy describes how we collect, use, and protect your information. By using the Services, you consent to our data practices as described in the Privacy Policy.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

11. Indemnification

You agree to indemnify and hold harmless XE and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Upon termination, your right to use the Services will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

14. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
